1. Acceptance
Welcome to Elementari, run by Elementari, LLC ("Elementari," "we," "us"). These Terms govern your use of the Elementari platform and our interactive reader and software (together, the "Services"). By accessing or using the Services in any way, you agree to these Terms and to all applicable laws. If you don't agree, please don't use the Site.
We may update these Terms from time to time; changes take effect 5 days after they're posted, and we'll try to notify you of major ones. The current version always lives at elementari.com/policy/terms. Please also read our Privacy Policy, which explains how we handle your information.
2. Who can use Elementari
You must be 13 or older to accept these Terms. If you're under 13, a parent, guardian, or teacher must consent on your behalf. If you're signing up as an educator, or as a parent or guardian creating an account for a child, you confirm you're 13+ and able to enter into this agreement. If you accept on behalf of a school or other organization, you confirm you're authorized to do so.
3. Accounts
An account lets you create, publish, and share projects and interact with others. You can register directly or through a third-party account (such as Google). You agree to provide accurate information, keep it current, and keep your login details confidential — you're responsible for activity under your account and may not transfer it. Tell us right away if you suspect unauthorized use.
3.1 Educators & schools
Teachers and schools may create student accounts accessed via a class code. By doing so, you confirm you have consent from parents or guardians for those students to use Elementari in the classroom, you'll keep access codes secure, and you'll follow our Privacy Policy.
3.2 Students
Students join a classroom with a class code from their teacher. If you're under 18, your parents must have given the teacher or school consent first. Keep your password and class code private. Student accounts have limited features to protect privacy — see the Privacy Policy for details.
4. Acceptable use
We grant you a non-exclusive, non-transferable, worldwide right to use the Site for your own purposes, subject to these Terms. All rights we don't expressly grant are reserved. To keep Elementari safe and enjoyable for everyone, you agree not to:
- copy, reverse engineer, or resell the Services or content except as allowed here;
- use bots, scrapers, or automated systems to inflate views, likes, or followers, or to harvest personal information (public search engines may index public content);
- attempt to identify, locate, or contact any student from their published work or profile;
- modify or block any part of the Embed feature, including links back to Elementari;
- post anything defamatory, offensive, or otherwise objectionable, or misrepresent your identity;
- send spam, chain letters, or unsolicited promotions; or
- infringe anyone's intellectual property or other rights, or break applicable laws.
We may discontinue any aspect of the Services at any time.
5. Your content
You own what you create. Elementari doesn't claim ownership of the projects and content you make ("User Content"), and nothing here stops you from using your own work elsewhere.
You're responsible for ensuring your User Content is yours to share and doesn't infringe anyone's rights or break any law. We don't allow copyright infringement and will remove infringing content when properly notified. We may review, move, edit, or remove content at any time, but we don't pre-screen everything and don't guarantee its accuracy or quality.
So we can actually run the Site, you grant Elementari a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt, and distribute your User Content for the purpose of operating, improving, and promoting the Services — including letting other users remix your published work within Elementari. This license continues for content that's already in use (for example, a project that remixes your work) even after you close your account, but otherwise ends when you delete your content or account.
6. AI features
Lesson generation and other AI-assisted tools are available to teacher accounts only — students never interact with them. Teachers must review generated materials before classroom use and are responsible for what they assign. We do not use student personal data in generation.
7. Plans & payments
Elementari offers a Free Plan and Paid Subscriptions. If a trial requires payment details, we'll charge the subscription fee when the trial ends unless you cancel first. Paid Subscriptions auto-renew each period until you cancel through Account Settings or by emailing support@elementari.com. School and district plans are governed by their order form.
Cancelling takes effect immediately and downgrades you to the Free Plan. All sales are final — we don't refund fees already paid, including for time remaining in a period. Current prices are on our pricing page; we'll give advance notice of any price change, which takes effect at your next renewal, and you can decline by cancelling before then.
You're responsible for keeping a valid payment method on file and for any taxes due. If a payment is declined, we'll email you to update your details; if it isn't updated within 10 days, your subscription will be cancelled. To change billing info, visit Account Settings or contact sales@elementari.com.
8. Termination
You can leave anytime by deleting your content or emailing us an "Opt Out Notice" at support@elementari.com. We may suspend or terminate accounts that breach these Terms, tamper with the Services, or harm Elementari or other users — which may include deleting account data and blocking further access. After termination you'll lose access to your account and its contents, and the content license in Section 5 continues only as described there.
9. Disclaimers & liability
Links to other sites are for convenience only and aren't endorsements — those sites have their own terms and privacy policies, and we're not responsible for them.
The Services are provided "as is," without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). We aren't responsible for content posted by users or third parties, or for interactions between users — you use the Site at your own risk.
To the fullest extent permitted by law, Elementari won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of (or inability to use) the Services. Some jurisdictions don't allow these limits, so they may not apply to you. You agree to indemnify Elementari against claims, losses, and reasonable legal fees arising from your use of the Services or breach of these Terms, including claims that your content infringes someone's rights.
